Phillip Ciano of Ciano & Goldwasser, LLP – Director of the firm’s commercial/ healthcare practice group – obtained a $700,000 settlement on behalf of an ophthalmologist/occuplastic surgeon who sued a national Lasik eye center in North Carolina for breach of contract and fraud.  After contentious litigation in AAA commercial litigation, Mr. Ciano obtained the settlement through the mediation process.

The underlying case involved a complex business dispute surrounding the proper allocation of fees amongst eye specialists utilizing femtosecond lasers for corrective eye surgery in a “volume practice” setting.  Drawing on his extensive commercial and healthcare background, Mr. Ciano was able to convince a mediator and Defendant’s insurer that his two doctor clients were entitled to a significant percentage of fees for performing “Step 1” in a 2-step Lasik procedure.
