Overview
Mr. DeRoberts' practice is focused on real estate transactions and related litigation. He is also actively engaged in complex business and personal injury litigation. He has represented investors, national landlords and tenants, tenants, owners, buyers, contractors, and investors in a wide range of transactions and litigation. David has extensive experience with purchase/sale, leasing, contract disputes, construction defects, seller fraud, mortgage fraud, title issues, evictions, quiet title and adverse possession, ejectment actions, forged deeds, boundary disputes, community association issues, and has served as outside defense counsel on title insurance claims.
As Assistant General Counsel for a major national retail REIT, he negotiated/drafted mall leases, amendments, and related documentation, negotiated/drafted master lease templates with national tenants, and advised mall managers/internal clients on operational, insurance, lien, and tort liability matters. He resolved disputes and claims with tenants, contractors, and shopping center patrons on matters involving lease disputes, personal injury claims, civil rights and access issues, OSHA, ADA and regulatory claims/violations, mechanic's and materialmen's liens, and collections matters. He also served as in-house counsel for a national title insurance company and the second largest bank in the United States, where he advised clients and customers on transactions involving exchanges of property under Section 1031 of the Internal Revenue Code.
Mr. DeRoberts has been an adjunct professor of law and was a frequent national speaker conducting continuing education seminars for lawyers, accountants and real estate brokers on a variety of topics in more than a dozen states.
