Phillip Ciano and Andy Goldwasser Obtain $1.5 Million "Garnishment" Settlement in Wrongful Death Action

Phillip Ciano and Andy Goldwasser employed a unique and novel approach in their representation of the Estate of Jane Doe.  This approach resulted in a $1.5 million dollar settlement, plus attorney fees and costs.

Ciano & Goldwasser initiated a wrongful death action against the decedent’s spouse, alleging he intentionally and/or negligently caused the death of Plaintiff’s decedent.  During the pendency of the wrongful death action, the Estate learned that the Defendant had transferred certain assets and funds from his personal and business holdings to various family members and entities.  Plaintiff’s counsel then joined the family and entities in a garnishment proceeding under a little-known and seldom used Ohio statute.

On the eve of the garnishment hearing, the garnishee-Defendants agreed to pay approximately $1.5 Million dollars, plus attorneys’ fees and costs, to settle the garnishment action.  Phillip Ciano and Andy Goldwasser will continue to pursue the wrongful death action against the Defendant on behalf of the Estate, notwithstanding its settlement with the garnishees.
